4. Children.

This website is intended for use by adults. Mr Target does not knowingly collect or use information from children. Individuals under the age of 18 may not use the Mr Target Services. Mr Target does not knowingly collect any information from children. If you are under 18, do not attempt to register for the Mr Target Services or send us any Personally Identifiable Information. By accessing, using and/or submitting information through the Mr Target Services, you represent that you are not younger than 18 and that you have authority to do so. If you are a parent or legal guardian of a minor child, you may, in compliance with this Privacy Policy, use the Mr Target Services on behalf of such minor child. Information you provide through the Mr Target Services on behalf of a minor child will be treated as Personally Identifiable Information as provided herein. If you use the Mr Target Services on behalf of another person, regardless of age, you represent and warrant that you have authority to do so.

5. ARBITRATION/CLASS ACTION WAIVER.

Any controversy, claim or dispute (collectively, “Dispute”) between you and Mr Target that may arise out of, or in connection with, your use and/or access to Mr Target’s website (“Website”) shall be resolved exclusively by binding arbitration administered by Judicial Arbitration and Mediation Services, Inc. (“JAMS”), pursuant to the JAMS Streamlined Arbitration Rules & Procedures, and conducted by a single, neutral arbitrator.

By using and/or accessing the Website, you agree that this constitutes a valid and enforceable written agreement to arbitrate under the Federal Arbitration Act, and that any dispute concerning this arbitration provision, including any such dispute as to the validity or enforceability of this provision, or whether a dispute or claim is arbitrable, shall be determined exclusively by the arbitrator selected by JAMS. If JAMS is unable or unwilling to arbitrate the Dispute, then the Dispute may be referred to any other arbitration organization or arbitrator the parties both agree upon in writing.

To start an arbitration proceeding, you must execute and serve a Demand for Arbitration on Mr Target by mailing it to 1701 W 10th St Suite 12, Tempe, AZ 85281, pursuant to the JAMS instructions. Arbitration shall take place by phone, unless an in-person hearing is requested either by you or Mr Target. In that case, the hearing shall take place in the county where you reside.

Neither you nor Mr Target will be able to have a court or jury trial, or participate in a class action or class arbitration. Other rights that you or Mr Target would have if you or Mr Target went to court will not be available or will be more limited in arbitration, including the right to appeal.

YOU AND MR TARGET ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED, REPRESENTATIVE ACTION, OR ANY SIMILAR PROCEEDING.
